For the purpose of these Terms and Conditions, the term “we”, “us”, “our” used anywhere on this page shall mean Here Mind. “you”, “your”, “user”, “visitor” shall mean any natural or legal person who is visiting our website (heremind.org) and/or agrees to purchase from us.
Here Mind sells print-on-demand products including but not limited to t-shirts, mugs, posters, tote bags (fulfilled via Qikink), journals (fulfilled via Pothi), and other custom merchandise. Your use of the website and/or purchase from us are governed by these Terms and Conditions, our Cancellation & Refund Policy, and all applicable Indian laws.
1. Website Content & No Warranty
The content of the pages of this website is subject to change without notice. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
Your use of any information or materials on our website and/or product pages is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services, or information available through our website meet your specific requirements.
2. Print-on-Demand Products
All products are custom-made to order after payment confirmation (typically within 24 hours). Slight variations in color, print placement, size (±0.5 inches tolerance), and materials may occur due to digital printing processes—these are normal and not grounds for returns. Journals and books are fulfilled by our partner Pothi.com, subject to their production timelines. Refer to our Cancellation & Refund Policy for full details on cancellations (pre-production only), returns (7-day defect window), and limitations.
3. Intellectual Property
Our website contains material owned by or licensed to us, including design, layout, look, appearance, and graphics. Reproduction is prohibited other than in accordance with our copyright notice. All trademarks reproduced on our website, which are not the property of or licensed to Here Mind, are acknowledged.
You represent that any custom designs you order do not infringe third-party rights. Prohibited content: hate speech, illegal, obscene, or copyrighted material without permission. We reserve the right to refuse/cancel violating orders. Unauthorized use of our information shall give rise to a claim for damages and/or be a criminal offense.
4. Links to Third Parties
From time to time, our website may include links to other websites (e.g., fulfillment partners like Qikink or Pothi). These links are provided for your convenience. We are not responsible for their content, policies, or actions. You may not create a link to our website from another site without Here Mind’s prior written consent.
5. Pricing, Payments & Limitation of Liability
Prices are in INR, exclusive of shipping/taxes, and may change without notice. Full payment is required upfront. We collect GST where applicable; you must provide accurate billing details. We shall be under no liability for any loss or damage arising from declined authorizations due to payment limits with our acquiring bank.
Our liability is limited to the order value paid. No responsibility for indirect losses, courier delays/damages, production variations, or force majeure. Products sold “as-is.”
6. Shipping & Third-Party Fulfillment
Orders ship via third-party couriers (estimates: 2-9 days domestic). Risk passes upon courier handover. RTO/undelivered items stored 100 days for reshipment. Fulfillment by Qikink (apparel/merchandise) and Pothi (journals)—we coordinate but are not liable for their processes.
7. Website Use & Prohibited Conduct
Use the site only for lawful purposes. No scraping, hacking, fraud, or automated access. We may suspend accounts for violations without notice.
8. Governing Law & Disputes
Any dispute arising from use of our website, purchases, or engagement with us is subject to the laws of India and exclusive jurisdiction of courts in Mumbai, Maharashtra.
